Now this is silly. As I see it, between Article I, Section 6:

... for any Speech or Debate in either House, they [Senators and Representatives] shall not be questioned in any other Place.
and Article 6, Clause 2:
This Constitution... shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby...
any judge who presumes to do anything with this case other than throw it out is wide open to impeachment, conviction, and removal.
